1. Nature of the Service
Provelio generates cryptographic evidence of file existence — specifically, SHA-256 hashes paired with RFC 3161 timestamps and blockchain anchors. Provelio does not provide legal advice, legal representation, or guarantee any legal outcome. A Provelio certificate is a technical artifact. It is not a legal document.
2. No Guarantee of Court Admissibility
Cryptographic timestamps may or may not be admitted as evidence in legal proceedings. Admissibility is determined solely by the presiding court, jurisdiction, and applicable rules of evidence at the time of the proceeding. Provelio makes no representation — express or implied — that any certificate generated by this service will be:
- Accepted as evidence by any court, tribunal, arbitration body, or regulatory authority;
- Treated as legally sufficient proof of any fact;
- Recognised as equivalent to notarisation, witnessed execution, or any other formal legal process;
- Admissible in any specific jurisdiction or under any specific evidentiary standard.
You assume full responsibility for any decision to rely on a Provelio certificate in legal, regulatory, or commercial proceedings.
3. Jurisdictional Limitations
The legal weight of cryptographic timestamps varies significantly by country and jurisdiction. While frameworks such as eIDAS (EU), ESIGN (US), and equivalent legislation in other countries provide legal recognition for certain electronic timestamp mechanisms, coverage is not universal. It is your sole responsibility to:
- Determine whether Provelio certificates are legally recognised in your jurisdiction;
- Obtain qualified legal advice before relying on a certificate in any proceeding;
- Comply with any local requirements regarding the use of cryptographic evidence.
4. Not a Substitute for Legal Advice
Nothing produced by Provelio — including certificates, PDF documents, verification links, blockchain proofs, or any content on this website — constitutes legal advice. You should consult a qualified legal professional licensed in your jurisdiction before using a Provelio certificate in any legal, regulatory, or commercial dispute, contract, or proceeding.
5. Service Interruption and Data Loss
Provelio is provided "as is" and "as available" without warranties of any kind, express or implied. Provelio is not liable for:
- Service outages, downtime, or unavailability for any reason;
- Loss or corruption of certificate data, proofs, or account information;
- Inability to access your account or certificates;
- Delays in blockchain anchoring or confirmation;
- Any loss — financial, reputational, or otherwise — arising from reliance on the service being available.
6. Blockchain and Third-Party Dependency
Proofs anchored to the blockchain via OpenTimestamps depend on third-party infrastructure outside Provelio's control. Provelio is not liable for:
- Failures, forks, hard forks, or protocol changes in the blockchain network;
- Unavailability or failure of OpenTimestamps calendar servers;
- Changes to the blockchain protocol that affect the verifiability of existing proofs;
- Any reduction in the legal or technical weight of blockchain-based proofs due to regulatory, technical, or network changes.
7. Limitation of Liability
To the maximum extent permitted by applicable law, Provelio and its operators, directors, employees, and agents shall not be liable for:
- Any indirect, incidental, consequential, special, exemplary, or punitive damages;
- Loss of profits, revenue, data, business, or goodwill;
- The outcome of any legal proceedings in which a Provelio certificate was used or relied upon;
- Court non-admission of a Provelio certificate as evidence;
- Any damages arising from reliance on the service being legally effective in any jurisdiction.
Where limitation of liability is not permitted by applicable law, Provelio's total liability to you for any claim is limited to the amount you paid to Provelio in the twelve (12) months immediately preceding the claim, or £100 GBP, whichever is less.
8. Indemnification
You agree to indemnify, defend, and hold harmless Provelio and its operators, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses — including reasonable legal fees — arising out of or in connection with:
- Your use or misuse of the Provelio service;
- Your reliance on a Provelio certificate in any legal, regulatory, or commercial proceeding;
- Your violation of these terms or any applicable law or regulation;
- Any third-party claim arising from your use of the service.
9. No Warranty
Provelio expressly disclaims all warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Provelio does not warrant that the service will be error-free, uninterrupted, secure, or that any defects will be corrected.
10. Changes to This Disclaimer
Provelio reserves the right to update this disclaimer at any time. Changes take effect upon posting to this page. Continued use of the service after changes constitutes acceptance of the updated disclaimer.
11. Governing Law
This disclaimer is governed by the laws of England and Wales, without regard to conflict of law principles. Any disputes arising under this disclaimer are subject to the exclusive jurisdiction of the courts of England and Wales.
